The Hon’ble Supreme Court, on 15th September 2020, in the matter of Jeet Ram v. The Narcotics Control Bureau, Chandigarh observed that where accused offers false answers in examination under Section 313 Cr.PC, same also can be used against him.
The Hon’ble Supreme Court observed that:
The appellate court would not interfere with the judgment of acquittal only because another view is possible but at the same time whether the findings recorded by the trial court in support of acquittal are valid or not is a matter which is to be considered with reference to facts of each case and evidence on record. (Para 10)
Where accused offers false answers in examination under Section 313 Cr.PC, same also can be used against him. (Para 11)
