SC: Pendency of civil proceeding not a good ground to not register a FIR

The Hon’ble Supreme Court, on 20th March 2020, in the matter of M. Subramaniam And Another v. S. Janaki And Another pronounced that mere pendency of the civil proceeding is not a good ground and justification to not register and investigate an FIR if a criminal offence has been committed.

The Hon’ble Supreme Court observed that:

A civil dispute should not be given the colour of a criminal offence. (Para 9)
